License and Use of Our Machine Embroidery Designs

You must have an embroidery machine in order to use our designs. All files are digital downloads — not finished products. Our designs may not be purchased and then brought to someone else to stitch onto a product. They are licensed solely to the purchaser of the designs. If you would like a design stitched onto a product, please have the person performing the embroidery purchase the files directly.

Our designs are available in the following formats only:

We do not provide designs in any other format. Downloaded designs are delivered to the account email address on file — we are unable to forward purchased designs to any other email address.

Eligibility

You must be at least 18 years old to create an account or make a purchase on Embroidery Treasure. By using our Service, you represent that you meet this requirement and that the information you provide us is accurate, complete, and current.

Design Sharing

Our embroidery designs — whether purchased or offered for free — may not be sold, traded, shared, given away, or included in any design set or bundle. This includes purchasing with the intent to copy and share with family or friends. You may not use any portion of our designs or artwork as the basis for creating a new design and presenting it as your own.

Every design in our library represents many hours of work to bring you unique, high-quality embroidery designs at affordable prices. Please respect that effort.

You may not team up with a friend or relative to "go in on" a purchase together — whether to split the cost, share a single account, or reach a discount tier. This is considered sharing and is strictly prohibited under these Terms of Use. We work hard to keep our prices low and accessible to everyone; please purchase your own membership or design set. (See "Items for Sale" below for commercial licensing.)

We will not respond to support requests regarding orders where two or more parties have split a purchase with the intent of sharing access or designs.

We reserve the right to immediately and without notice suspend or terminate the download access of any account holder found to be sharing designs or violating these terms. Designs are made available for instant download as a convenience upon purchase or active membership — we are not obligated to provide indefinite or unlimited access, and that access may be revoked for violations of these terms.

You may not alter our designs and present the altered version as your own work, nor may you sell altered designs. You are, of course, welcome to edit designs for your own personal, non-commercial use.

By purchasing or downloading our designs, you are purchasing a license to use them — not the designs themselves. This license belongs solely to the account holder who made the purchase and is non-transferable. You may not, at any time, pass design files to any other person for any reason without express written permission from Embroidery Treasure. All designs and the copyrights therein remain the property of Embroidery Treasure and are protected under international copyright law.

Using Our Designs on Items for Sale

We love seeing our designs stitched onto items you sell! Our designs may be used on items for sale, provided they are not mass-produced (i.e., hiring others to stitch the designs or running them on a production line). As long as the individual license holder is the one stitching the designs, there is no limit to how many times they may be used on items for sale. Any design used on items for sale must be a purchased design.

Free designs: Our free designs may not be used on items for sale. If you intend to profit from a design, you must purchase it.

While you're welcome to stitch our designs onto items for sale — including iron-on appliqué patches — you may not claim to be the creator or designer of the designs themselves. Many of our designs are digitized from artwork licensed exclusively for Embroidery Treasure. This policy exists to protect our copyrights and those of our artists. Thank you for understanding and respecting it.

For joint businesses or partnerships involving two or more embroiderers, a separate license must be purchased for each individual. Our designs are licensed to one person only — each embroiderer in a shared business must hold their own purchased copy. This is consistent with standard commercial multi-user licensing practices (e.g., "2-user license," "3-user license"). Thank you for complying with this policy.

Physical Orders & USB Shipping

From time to time, we may offer physical products — such as USB drives preloaded with designs — shipped directly to your address. By placing such an order, you confirm that the shipping information you provide is accurate and complete; we are not responsible for orders delayed or lost due to incorrect address details.

Processing and shipping times will be noted on the relevant product page and may vary based on your location, carrier delays, customs processing (for international orders), or other circumstances beyond our control.

Shipping costs, where applicable, will be calculated and displayed at checkout. International customers are responsible for any customs duties, taxes, or import fees charged by their country.

Because these products contain digital design files at the time of sale, physical USB orders are non-refundable and non-returnable once shipped, except where the item arrives damaged or defective — in which case please contact us at [email protected] within 7 days of delivery.

We are not responsible for packages confirmed as delivered by the carrier to the address provided but not received by you (e.g., lost, stolen, or misdelivered after delivery confirmation).

Use of Our Design Images

If you run a business website, sell on Etsy or Facebook, or offer customers a choice of designs to be stitched onto an item, you're welcome to display our stitch-out preview images — provided you give credit by stating "These designs purchased from Embroidery Treasure" and link back to our website at www.embroiderytreasure.com. If you'd prefer not to credit us, you must stitch out and photograph your own samples instead. You may not use our images without giving proper credit.

You may only use our design preview images for designs you have purchased.

If you've created projects or items using our designs, we'd love to feature them in our community! Email your showcase photos to [email protected].

Note: Please do not send us any information you consider personal or sensitive, or that you would not want shared publicly online.

Your Account

You may not share your login credentials with another individual. As a convenience, your account dashboard allows you to view your purchase and download history and re-download designs you've previously unlocked, should you lose them or experience a computer crash. Please keep your login and password private. Downloads are tracked and monitored on a regular basis. If we find an account being used to download designs across multiple devices or shared by more than one person, download access may be suspended without notice and further download privileges revoked.

We strongly recommend downloading your designs as soon as you unlock them. While previously-downloaded designs remain available for re-download from your account at no additional cost, please remember that we provide digital machine embroidery designs — not cloud storage. This re-download convenience is offered for your benefit only, and Embroidery Treasure reserves the right to change this policy at any time. Embroidery Treasure is not responsible for designs that are lost if you have not downloaded and saved them to your own device.

Refunds, Returns and Exchanges

Due to the digital nature of our designs and the fact that they are available for instant download, all sales are final. This includes subscription payments and credit purchases — no refunds, returns, or exchanges are offered.

If you experience a technical problem with a purchased design — such as a corrupted file or an incorrect format — please contact us at [email protected] to report the issue. We don't anticipate problems with our files, but errors can occasionally occur, and we will do everything we can to correct them. If we're unable to resolve the issue, we will, at our discretion, credit the affected amount back to your account in the form of download credits.

Please do not file a dispute or chargeback with your bank, credit card provider, Stripe, or PayPal before reaching out to us for support. Filing a dispute before contacting us will result in your account being locked until the dispute is resolved and we are compensated for the products provided.

Free Trial

From time to time, we may offer a free trial period for one or more of our membership plans. The length and terms of any free trial will be clearly stated at the time of sign-up.

You may be asked to provide billing information to start a free trial. If you do, you will not be charged during the trial period. Unless you cancel before the trial ends, you will be automatically charged the regular subscription fee for the plan you selected once the trial period expires.

We recommend setting a reminder before your trial ends if you do not wish to continue — you can cancel anytime from your account dashboard before the renewal date to avoid being charged.

We reserve the right to modify, limit, or end any free trial offer at any time and without notice, and to determine your eligibility for a free trial at our sole discretion (for example, free trials may be limited to new members only).

Stitching Issues With Our Designs

All designs are tested for quality before being released to our library. If you experience a stitching issue related to one of our digitized files, please contact us at [email protected]. Embroidery Treasure is not liable for items that may be damaged during stitch-out.

If you're stitching onto an expensive or irreplaceable item, we strongly recommend doing a test stitch-out first, as results can vary depending on fabric, stabilizer, hooping, machine settings, and tension. Please reach out to us with any concerns before stitching a purchased design onto a finished item. We do not provide reimbursement or compensation for damaged embroidery blanks, including clothing, bags, towels, or any other materials.

Embroidery Editing Software

Our designs are manually digitized for efficiency, accurate stitch count, and proper stitch sequencing. All designs are tested for quality prior to being made available, and we guarantee their quality in the file formats and sizes we provide.

We are unable to guarantee the quality or stitch-out of any design that has been resized, edited, merged, or opened in third-party embroidery editing software that may alter its original settings (for example, software that automatically color-sorts, changes stitch sequence, removes overlaps, or modifies underlay). If you choose to open, edit, or export a design using embroidery editing software, we recommend that you be proficient with that software first. Due to the wide variety of programs and settings available, we are unable to provide support for issues that arise from edited or re-exported files.

Use of Our Artwork

Our designs are intended for machine embroidery purposes only. All designs — including the graphic artwork used to create them — are protected by copyright. This artwork may not be used for any purpose other than machine embroidery, including (but not limited to) scrapbooking, silk-screen printing, vinyl designs, smocking, or SVG/cut files. You may not use the artwork or imagery from one of our designs to create a manual appliqué pattern, nor may you use any portion of our designs or exclusive artwork as the basis for a new design that you present as your own.

You may not create derivative works from our artwork for sale, including SVG or cut files, and you may not use our artwork or appliqués as the basis for new designs. Our artwork is licensed exclusively to Embroidery Treasure and is intended for machine embroidery purposes only.

Limitation of Liability

To the maximum extent permitted by law, Embroidery Treasure and its owners, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, profits, or business interruption — arising from your use of, or inability to use, our Service or designs.

Our total liability for any claim arising from your use of the Service or purchased products shall not exceed the amount you actually paid us in the twelve (12) months preceding the claim.

The Service and all designs are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.

Termination

We may suspend or terminate your account and access to the Service at any time, without prior notice or liability, for any reason — including, without limitation, a breach of these Terms of Use.

Upon termination, your right to access and download designs through your account will cease immediately. If you wish to close your account, you may simply cancel your subscription and discontinue use of the Service.

Governing Law

These Terms of Use shall be governed by and interpreted in accordance with the laws applicable in our place of business, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of that jurisdiction.

Changes to These Terms

We may update or revise these Terms of Use at any time. The updated version will be indicated by a revised "Last updated" date at the top of this page. Material changes will be communicated where appropriate. Your continued use of the Service after any revisions take effect constitutes your acceptance of the updated Terms.
